Important: These Terms & Conditions govern access to the MHEKO website (https://mheko.com/) and purchases made through it. These Terms do not exclude or limit any right or remedy that cannot legally be excluded under applicable Indian law.

1. Acceptance of These Terms

These Terms & Conditions ("Terms") form a binding agreement between you and The Artless ("The Artless", "MHEKO", "we", "us" or "our").

These Terms apply when you browse the MHEKO website, create an account, provide information, place an order, submit reviews or other content, or use any service made available through the website.

By using the MHEKO website or placing an order, you confirm that you have read and accepted these Terms, our Privacy Policy, Shipping Policy, Cancellation Policy and Returns & Refund Policy.

If you do not agree with these Terms, please do not use the website or place an order.

References to "MHEKO", "we", "us" or "our" in these Terms refer to The Artless and the MHEKO brand.

Our products may include diffuser oils, essential oils intended for diffuser use, diffusers, candles, gifting products, accessories and other products listed on the MHEKO website.

3. Eligibility and Account Responsibility

You must be legally competent to enter into a contract under applicable Indian law to place an order.

A minor may use the website or make a purchase only with the involvement and permission of a parent or lawful guardian where required by law.

If you create an account, you are responsible for:

Providing accurate and complete information.
Maintaining the confidentiality of your account credentials.
Keeping your contact and delivery information updated.
Notifying us of suspected unauthorised use of your account.

We may verify contact, delivery or payment information before accepting an order.

We may refuse, restrict or cancel an account or transaction where we reasonably suspect fraud, misuse, impersonation, unlawful activity or other prohibited conduct.

4. Product Information

We make reasonable efforts to ensure that product names, descriptions, images, quantities, colours, materials, features, prices and availability displayed on MHEKO are accurate.

Natural oils may have reasonable variations in colour or aroma.
Product availability may change without prior notice.

You should read the product description, label, usage directions and safety information before using any product.

Website descriptions are provided for general product information and do not replace instructions or warnings supplied with the product.

If information on the website differs from a mandatory product declaration or instruction provided on the delivered product, please contact us before use.

5. Diffuser Oil and Product Safety

MHEKO's diffuser oils and essential oils should be used only for their stated purpose and according to the instructions provided with the product.

Unless a product is expressly labelled and legally authorised for another purpose, MHEKO diffuser oils are intended for diffuser use only and are not intended for direct application to skin or consumption.

Do not ingest diffuser oils or essential oils.

Avoid contact with eyes and sensitive areas. Keep oils and other MHEKO products away from children, pets, excessive heat and open flames where applicable.

Use diffusers and candles according to their respective product instructions and safety warnings.

If irritation, discomfort or an adverse reaction occurs, discontinue use and seek appropriate professional advice where necessary.

MHEKO products are not represented as medicines and are not intended to diagnose, treat, cure or prevent disease unless expressly authorised and labelled for such purpose.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from defective products or inadequate legally required warnings.

6. Prices, Taxes and Offers

Prices on MHEKO are displayed in Indian Rupees (INR) unless otherwise stated.

Applicable taxes and charges will be displayed at checkout or on the invoice where required.

Any applicable delivery charges will be displayed before you complete your purchase.

We may change product prices prospectively. A price change will not normally affect an order that has already been accepted.

If a product is listed at an obvious pricing or description error, we may correct the error where permitted by applicable law.

Coupons, discounts and promotional offers are subject to their individual terms, validity periods and availability.

Unless expressly stated otherwise, offers cannot be combined or exchanged for cash.

7. Orders and Contract Formation

When you place an order on MHEKO, you are making an offer to purchase the selected products.

An automated order confirmation or acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when we confirm acceptance or dispatch the product, whichever occurs first.

We may reject or cancel an order before acceptance because of circumstances including:

Product unavailability.
Incorrect price or product information.
Payment failure.
Delivery restrictions.
Suspected fraud or misuse.
Technical errors.
Legal or regulatory requirements.

If an order is cancelled after payment has been received, we will initiate an applicable refund according to our Refund Policy and applicable law.

8. Payment

You must use a payment method that you are authorised to use.

Payments may be processed through independent payment gateways or financial institutions. Their own terms and privacy policies may apply.

MHEKO will not ask you to provide your UPI PIN, banking password or complete card credentials through customer support.

If you receive a suspicious payment request claiming to be from MHEKO, please contact us through the official contact details on our website.

An order may be placed on hold or cancelled if payment is unsuccessful, reversed, flagged for review or not received.

9. Shipping and Delivery

Shipping and delivery are governed by the MHEKO Shipping Policy available on the website.

Orders are generally processed and dispatched within 1 business day after confirmation.

Delivery is generally expected within 3–4 business days after dispatch, although actual delivery time may vary by location and circumstances.

MHEKO currently offers shipping across India, subject to service availability.

You are responsible for providing a complete and accurate delivery address and an active contact number.

Delivery delays may occur because of weather, transportation disruptions, public holidays, remote-area serviceability, local restrictions or other circumstances beyond our reasonable control.

Nothing in these Terms removes any statutory consumer rights relating to delivery.

10. Cancellation, Returns and Refunds

Order cancellations, returns, refunds, damaged products, incorrect products and replacement requests are governed by the applicable Cancellation Policy and Returns & Refund Policy displayed on the MHEKO website.

These policies form part of these Terms and are subject to mandatory consumer rights under applicable law.

For hygiene, safety and product-protection reasons, opened or used diffuser oils, essential oils and certain other products may not be eligible for change-of-mind returns where permitted by law.

This does not remove applicable remedies where a product is defective, damaged, incorrectly supplied, materially misdescribed, short in quantity or otherwise does not comply with applicable law.

Customers may be asked to provide reasonable evidence, such as photographs, videos, order information and product or packaging details, to help us assess a claim.

11. Reviews and User Content

If you submit a product review, photograph, comment or other content to MHEKO, you confirm that the content:

Is truthful and based on a genuine experience.
Does not infringe another person's rights.
Is lawful and non-confidential.
Does not contain inappropriate personal information.
Does not promote unsafe or unlawful product use.

You retain ownership of content you submit. However, you grant The Artless a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating, marketing and promoting MHEKO.

We may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing, inappropriate or inconsistent with these Terms.

A genuine negative review will not be removed merely because it is critical of MHEKO or a product.

12. Prohibited Uses

You must not use the MHEKO website to:

Commit fraud or engage in unlawful activity.
Impersonate another person or business.
Submit false order, payment, delivery, review or grievance information.
Attempt unauthorised access to the website or its systems.
Introduce malicious software or code.
Interfere with website security or operation.
Scrape or collect website information at a disruptive or unauthorised scale.
Copy, reproduce, resell or commercially exploit MHEKO content without permission, except where permitted by law.
Make unauthorised medical, therapeutic, certification, safety or origin claims about MHEKO products.
Use MHEKO branding or product content in a misleading manner.

13. Intellectual Property

The MHEKO name, logo, branding, packaging designs, product photographs, website design, graphics, text, product descriptions and other original materials are owned by or licensed to The Artless and are protected by applicable intellectual-property laws.

You may view and use the MHEKO website for personal and lawful shopping and information purposes.

No ownership or other intellectual-property rights are transferred to you through your use of the website or purchase of a product.

14. Third-Party Services and Links

MHEKO may use or link to third-party services, including:

Payment gateways.
Courier and logistics providers.
Shiprocket and related services.
Analytics services.
Social-media platforms.
Other technology or service providers.

Third-party services operate under their own terms and privacy policies.

The Artless does not control the independent websites, availability, security or practices of third-party services, except to the extent responsibility is imposed on us by applicable law.

15. Website Availability

We may update, modify, maintain, suspend or discontinue certain website features from time to time.

We do not guarantee that the website will always be uninterrupted, completely error-free or continuously available.

We will take reasonable steps to protect confirmed orders and legally required records during significant service interruptions or changes.

16. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the MHEKO website is provided on an available basis.

We are not responsible for indirect or consequential losses arising solely from circumstances such as:

Temporary website interruption.
Unauthorised account use caused by failure to protect your credentials.
Misuse of products contrary to clear instructions or warnings.
Third-party systems outside our reasonable control.

Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited, including fraud, wilful misconduct, death or personal injury caused by negligence, defective products, breach of mandatory consumer rights or other statutory remedies.

17. Indemnity

To the extent permitted by applicable law, you agree to compensate The Artless for direct losses, liabilities and reasonable costs arising from your:

Unlawful use of the MHEKO website.
Fraudulent conduct.
Infringement of another person's rights.
Material breach of these Terms.

This does not apply to losses caused by our own breach, negligence or unlawful conduct.

18. Suspension and Termination

We may suspend or restrict access to the website where reasonably necessary to address:

Fraud.

Unlawful conduct.
Material violations of these Terms.
Misuse of our website or services.

Where practical and legally permitted, we may provide notice and an opportunity to resolve the issue.

Termination or suspension does not affect rights and obligations relating to accepted orders, payments, refunds, intellectual property, disputes or provisions intended to survive termination.

Material changes will not retrospectively alter an accepted order unless required by law or agreed with you.

Nothing in these Terms prevents a consumer from exercising any statutory right to approach a competent Consumer Commission, authority or other forum available under applicable law.

Subject to applicable consumer rights and jurisdictional requirements, courts having lawful jurisdiction in Delhi, India may have jurisdiction over disputes concerning these Terms.

23. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

These Terms, together with the MHEKO Privacy Policy, Shipping Policy, Cancellation Policy, Returns & Refund Policy and applicable order confirmation, constitute the agreement governing your use of the website and relevant purchases.

Failure to enforce a provision on one occasion does not constitute a waiver of that provision.
